Entry Clearance applications are now being accepted for Turkish nationals who wish to establish themselves in business in the UK, whether via a new or existing business, under the Turkey - European Community Association Agreement ('the ECAA').
Applications can be made using form VAF2. There is also a page of additional questions to be completed. This can be obtained at the Visa Application Centres.
Persons who are considered to have participated in fraud/abuse in relation to their application will not be accepted.
Fraudulent/abusive activity is considered to include, but is not limited to, any of the following conduct.
Applying to establish in business or having already established in business in the UK:
having entered or having sought to enter the UK illegally;
having sought or obtained leave by deception;
whilst in breach of the conditions of leave to enter or remain;
whilst on temporary admission or absconding from temporary admission;
having made an asylum claim that is discredited;
having made false representations and/or failed to disclose material facts whilst making your application
If you are ineligible to apply under the terms of the ECAA you will only qualify for leave if you meet the requirements of the PBS Tier 1 (Entrepreneur) category in the current rules (paragraphs 245H - 245K of HC395 apply). Your application will also be assessed against the grounds in paragraph 320 of HC395.
The authenticity of the documentation you provide in support of your application will be verified by entry clearance staff and further inquiries made as necessary. All documentation must be in English, with certified translations wherever necessary. Documents not in English will not be taken into account when the application is assessed. You may also be called for interview at the overseas mission dealing with your application. Your application will also be referred to the specialist ECAA team for an assessment before entry clearance staff make a final decision on your application.
Those who wish to apply for entry under Tier 1 categories (including as an Entrepreneur) and the Business Visitor category can continue to do so and such applications will be considered under the procedures in place for them as set out in the Immigration Rules
